Most people write a Will with the best of intentions, then leave it untouched for years. The recent case of McDaniel v Talbot demonstrates just how quickly life can outgrow an outdated Will and why it is important to keep your Will under regular review.
In 2014, Mark Talbot made a Will expressly excluding his daughter, Emma. Mark and Emma’s mother separated when she was a baby and Mark did not maintain a relationship with his daughter. At the time, his decision reflected the circumstances of their relationship. However in 2019, three years before Mark’s sudden death, father and daughter reconciled. Emma and Mark went on to build a close relationship, spending time together at his villa in Portugal and speaking regularly.
Although Mark and Emma’s relationship changed significantly, his Will did not. When Mark died, his estate, valued at £1.75 million, passed entirely to his wife, Rosemary.
Emma brought a claim against her father’s estate under the Inheritance (Provision for Family and Dependants) Act 1975. The Court took account of Emma’s financial circumstances; she was reliant on state benefits and had two disabled children. Mark’s widow, Rosemary, was already well provided for. As a result, despite the clear exclusion clause in the Will, Emma was awarded £123,418, representing around 8% of the estate.
Had Mark updated his Will following his reconciliation with Emma, he may have chosen to make provision for her and potentially avoided a claim against his estate. Instead the Court was required to consider an out of date Will and accompanying statement, which the judge concluded no longer reflected the reality of Mark and Emma’s relationship.
This case serves as a timely reminder that a Will should not be viewed as a document that is written once and then forgotten. Significant life events, such as marriage, divorce, births and changes in financial circumstances can all affect whether a Will continues to reflect a person’s wishes.
